Trucking info – A bill newly proposed in the House would amend the Internal Revenue Code of 1986 to change the classification of employers and employees. “Currently, it is difficult and overly complicated for businesses to use independent contractors, which limits companies’ growth and individuals’ work,” said Rep. Erik Paulsen (R-MN), who introduced H.R. 3396 on July 25. He added that this legislation “provides clarity and guidance for businesses so they know they are properly classifying independent contractors without fear of IRS penalties.” Read more.
Los Angeles Times – Federal immigration agents have shown up twice at California labor dispute proceedings to apprehend undocumented workers, in what state officials believe may be cases of employer retaliation.
Trucking companies have evaded wage laws by classifying workers as independent contractors. They don’t pay overtime and force drivers to pay for the cost of fueling and maintaining their trucks. After those payments, for which they aren’t reimbursed, drivers end up earning less than the minimum. Since 2011, the Labor Commissioner’s Office has concluded that drivers were misclassified as independent contractors in about 300 wage-claim cases. Read more.
Politico – In a letter sent to the CEOs of 16 companies, including Target and Walmart, the lawmakers demanded that the corporations ensure that they are “not complicit in the mistreatment of port truck drivers” and that they “are not unwittingly supporting labor abuses in the United States.” The letter, led by Sen. Sherrod Brown (D-Ohio), came after USA Today published an investigation in June that found “port trucking companies in southern California have spent the past decade forcing drivers to finance their own trucks by taking on debt they could not afford.” The lawmakers requested that the companies inform them about their steps to “rid worker abuses” from their supply chain. In addition, the lawmakers asked the CEOs whether they plan to cancel contracts with companies that have committed safety and labor violations.

On Monday, July 31, Sens. Sherrod Brown, D-Ohio; Elizabeth Warren, D-Mass.; Dianne Feinstein, D-Calif.; and Kamala Harris, D-Calif., penned a letter that asked retail companies to crack down on trucking companies that commit labor violations. A June article from USA Today, presented an investigative report alleging that retail giants have enabled the exploitation of port truck drivers. The article stated that “Target, Costco, Hewlett-Packard and many others have benefited from California port trucking companies that forced their drivers into debt, made them work up to 20 hours a day, and sometimes paid them pennies per hour.” The article also claimed that at least 140 trucking companies around Los Angeles have been accused of improperly billing drivers for their own work equipment by calling them independent contractors instead of employees.
